LAST UPDATED: 15/07/2026

These terms of service (hereinafter, the "Terms of Service" or, interchangeably, the "Sales Policy") govern the purchase of products and the booking, contracting of or participation in services offered by KITSUNE INVESTMENTS, S.L., under the trade name DESTILO DRINKS, through the online store incorporated into the website hosted under the domain name destilodrinks.com and, where applicable, any subdomains or sections dependent thereon (the "Website").

Placing an order, booking or contract through the online store incorporated into the Website (the "Online Store") confers the status of customer (the "Customer") and requires express acceptance of these Terms of Service before becoming bound by the relevant purchase, booking or contract.

These Terms of Service are complemented by the Legal Notice, the Privacy Policy, the Cookie Policy and, where applicable, the Particular Conditions, product sheets, experience pages, confirmation communications, promotions or operational instructions specifically indicated before contracting.

The Particular Conditions accepted for a product, service, promotion, voucher, event or B2B contract shall prevail over these Terms of Service in respect of what they specifically govern, provided that they do not prejudice the Consumer's mandatory rights.

4.4. DESTILO DRINKS may suspend, reject, cancel or review orders where there are reasonable indications of fraud, abuse, unauthorised resale, impersonation, use of false data, breach of age restrictions or any use contrary to the law, the Legal Notice or these Terms of Service.

5. MINIMUM AGE, RESPONSIBLE SALE AND ACCESS CONTROL FOR ALCOHOLIC BEVERAGES.

5.1. The sale, delivery, supply, tasting and consumption of alcoholic beverages are limited to persons who are of the minimum legal age applicable in the territory of sale, delivery, provision or consumption. In Spain, the general minimum age to purchase or receive alcoholic beverages is 18 years.

5.6. DESTILO DRINKS promotes the responsible consumption of alcoholic beverages and may deny the sale, delivery, collection, access or participation where the minimum legally required age cannot be verified, where there are indications of purchase for minors, irresponsible consumption, intoxication, safety risk, breach of territorial or time restrictions, or any other legally relevant circumstance.

6. PRE-CONTRACTUAL INFORMATION ON PRODUCTS, SERVICES AND CONTRACTING.

6.1. Before becoming bound by an order, the Customer shall have access to the essential contractual information that applies, including the identity of the seller, the main characteristics of the products or services, the total price, taxes, shipping or additional costs, means of payment, delivery or collection methods, cancellation or withdrawal conditions, age restrictions, available territories and customer service channels.

6.2. The sheet, page or screen of each product or service shall indicate, where applicable, its name, description, format, volume, alcoholic strength, price, origin, producer or supplier, tasting notes, serving recommendations, storage, availability, maximum units, date, time, duration, place, places, capacity, language, food or drinks included and any other applicable Particular Conditions.

6.3. The Customer must carefully review the product or service sheet, the cart and the order summary before confirming the contract. The information shown in the cart may be an estimate where so indicated, especially in respect of shipping costs, discounts, taxes or available methods, which must be confirmed during the purchase process and always before payment.

6.4. Photographs, images, illustrations, graphic labels, recommendations, mentions such as "staff pick", tasting notes, pairing suggestions, product stories or editorial content are intended for

informational and descriptive purposes, without prejudice to the obligation for the essential contractual information to be truthful, sufficient and not misleading.

6.5. If the Customer detects a relevant error, inaccuracy or discrepancy in the information of a product or service before contracting, they must refrain from placing the order and contact DESTILO DRINKS. If the discrepancy is detected after delivery or provision, the provisions of these Terms of Service and the applicable legal rights shall apply.

7. FOOD INFORMATION, STORAGE, ALLERGENS AND SPIRIT DRINKS.

7.1. In the distance sale of packaged food products, DESTILO
DRINKS shall make available to the Customer, before the purchase is finalised and at no additional cost, the mandatory food information required, with the exception of those particulars whose prior availability is not legally required before purchase. At the time of delivery, all mandatory particulars shall be available.

7.2. Where applicable, the food information may include the name of the food, the list of ingredients, substances or products causing allergies or intolerances, net quantity, special storage or use conditions, food business operator details, country of origin or place of provenance where mandatory, instructions for use where necessary, the alcoholic strength by volume and any other required particulars.

7.3. The Customer must carefully read the labelling, packaging, documentation, instructions and storage conditions accompanying the product at the time of delivery, especially regarding allergens, intolerances, alcoholic strength, refrigeration, temperature, minimum durability date, use-by date, best-before date, handling and responsible consumption.

7.4. In the event of a relevant discrepancy between the information shown in the
online store and the label, packaging or documentation accompanying the product, the Customer must refrain from consuming it and contact DESTILO DRINKS. The foregoing is without prejudice to their legal rights regarding conformity, return, refund, food safety and product liability.

7.5. In the case of spirit drinks, alcoholic beverages, low-alcohol beverages, fermented products, non-alcoholic products, mixers, syrups or other regulated products, the name, designation, presentation, labelling,

use of protected names, geographical indications, strength, origin and commercial particulars must comply with the applicable sectoral regulations.

7.6. Recommendations on pairing, serving, temperature, storage, tasting notes or sensory experiences are provided for guidance only and do not constitute a guarantee of personal preference, a specific organoleptic result or fitness for a use other than that indicated by the manufacturer, producer or DESTILO
DRINKS.

8. AVAILABILITY, STOCK, CAPACITY AND PURCHASE LIMITATIONS.

8.1. The products and services are offered within the limits of availability, stock, capacity, places, schedules, dates, delivery territories, age restrictions and other applicable legal, technical, commercial or operational restrictions.

8.2. DESTILO DRINKS may limit the maximum number of units of the same Product that may be added to the cart or purchased in a single order, especially due to limited availability, special edition, reduced stock, resale risk, logistical restrictions or responsible consumption controls.

8.3. Adding a product to the cart does not guarantee its definitive reservation. Stock, price, delivery conditions and available places may vary until the order is confirmed, without prejudice to the final information that must be shown before the Customer becomes bound by the contract.

8.4. If a contracted product or service is not available after the order has been confirmed, DESTILO DRINKS shall inform the Customer without undue delay and shall offer them, as appropriate, cancellation with a refund, replacement with an equivalent product or service if the Customer accepts it, or rescheduling of the service where possible.

8.5. DESTILO DRINKS shall not be obliged to supply products or services where there is legal impossibility, actual lack of availability, manifest error, impossibility of payment, impossibility of delivery, impossibility of age verification or force majeure, without prejudice to the refund due to the Customer for amounts actually paid and not enjoyed.

9. DESTILO CLUB, PRE-ORDERS, EXCLUSIVE PRODUCTS AND LIMITED AVAILABILITY PRODUCTS.

9.1. DESTILO DRINKS may offer, through DESTILO Club, its Website, commercial communications or specific campaigns, early access, invitations, promotions, pre-orders, exclusive products, limited availability products, special batches, numbered editions, events, tastings, experiences or commercial advantages.

9.2. Membership of, enrolment in, invitation to or access to DESTILO Club does not, in itself, guarantee the availability, reservation, definitive allocation, delivery or right of acquisition of a specific product or service, unless expressly stated in the applicable Particular Conditions.

9.3. Where a product is offered as a pre-order, as a
limited availability product, exclusive product, special edition, reserved batch, product in transit, product pending import, product subject to supplier receipt or product with a future delivery date, the product sheet or the Particular Conditions must inform, before contracting, of the essential applicable conditions, including, where applicable:

  • Limited or exclusive nature of the product;
  • Number of units available or allocation criterion, if communicated;
  • Estimated date of availability, dispatch or delivery;
  • Territorial, logistical, tax, regulatory or age restrictions;
  • Payment, booking, cancellation or refund conditions;
  • Possibility of replacement with an equivalent product, only if the Customer accepts it;
  • Circumstances that may prevent delivery, including supervening lack of availability, legal impossibility, import incident, recall, defect, contamination, food safety problem, manifest error or force majeure.

9.4. If a product purchased on pre-order or through DESTILO Club cannot be delivered after the order has been confirmed for legal, regulatory, logistical, tax, import, supplier, food safety, age verification, actual lack of availability or force majeure reasons, DESTILO DRINKS shall inform the Customer without undue delay and shall offer them, as appropriate, a refund of the amounts paid for the undelivered product, replacement with an equivalent product if the Customer accepts it, or a voluntary alternative commercial solution.

9.5. Under no circumstances shall DESTILO DRINKS be obliged to deliver products that are not safe, that do not comply with the applicable regulations, that cannot be lawfully marketed, or that have not passed import, labelling, traceability, food information, safety, minimum age or mandatory documentation controls, without prejudice to the legal rights of the Customer.

9.6. DESTILO DRINKS may limit units per customer, account, address, payment method, promotion or campaign in the case of limited availability products, exclusive products, DESTILO Club, pre-orders, premium products, resale risk, responsible consumption or fraud prevention.

9.7. Unauthorised resale, abusive use of accounts, codes or invitations, circumvention of purchase limits, purchase for minors or the use of false data may give rise to the rejection, cancellation or review of the order, without prejudice to the mandatory rights of the Consumer.

10. PRICES, TAXES, COSTS, PROMOTIONS AND CODES.

10.1. The applicable prices shall be those shown in the online store at the time of contracting, except in the case of manifest error. Prices shall be shown in euros and shall include the applicable taxes, unless expressly stated otherwise.

10.2. Shipping, delivery, collection, handling, preparation, additional services, discounts, promotional codes and any other additional costs shall be indicated before the Customer confirms the order and becomes bound by a payment obligation.

10.3. If the online store shows an "estimated total" in the cart, that amount must be understood as an estimate prior to the payment screen. The definitive contractual amount shall be the one shown in the final order summary before pressing the payment or contracting button, once taxes, shipping costs, discounts and available methods have been applied.

10.4. Discounts, promotional codes, campaigns, invitations, credits, vouchers, gift cards, welcome offers or promotions shall be subject to the Particular Conditions indicated in each case. Unless expressly stated, they shall not be combinable with each other, shall not be redeemable for cash, may not be applied retroactively and may be limited by territory, product, service, date, stock, places, minimum age or minimum purchase amount.

10.5. DESTILO DRINKS may withdraw, suspend or modify promotions at any time, without affecting orders already confirmed, except in the case of manifest error, abuse, fraud, use contrary to the conditions of the promotion or legal requirement.

10.6. Any commercial statement relating to free returns, first-purchase discounts, free shipping, delivery within a specific timeframe, availability of places, opening of bookings or promotional advantages must be interpreted in accordance with the specific conditions published in the online store. If a commercial policy of "free returns" or equivalent is maintained, its scope, territories, timeframes, excluded products and procedure must be clearly indicated.

10.7. Where a price reduction, discount, struck-through price, offer, markdown, promotion or equivalent economic advantage is announced, DESTILO DRINKS shall indicate the previous price and the reduced price on the terms required by the applicable regulations, unless a legally applicable exception applies.

10.8. Promotions aimed at DESTILO Club members, private codes, invitations, early access, welcome discounts, gifts, bundles, packs, loyalty advantages or special campaigns shall be subject to the Particular Conditions indicated in each case, which must state their duration, territorial scope, products included or excluded, unit limits, compatibility with other codes, minimum amount, age restrictions, availability, method of redemption and, where applicable, the associated processing of personal data.

10.9. Promotions relating to alcoholic beverages shall not be directed at minors, shall not encourage irresponsible, immoderate consumption or consumption contrary to the applicable regulations, and may be subject to additional controls on age, territory, schedule, availability or delivery.

10.10. If a promotion, discount, code, price, gift, advantage or availability has been published with manifest error, fraudulent use, abuse, technical manipulation, breach of conditions or legal impossibility, DESTILO DRINKS may reject, cancel or review the affected order, informing the Customer and refunding the corresponding amounts where applicable.

10.11. Prize draws, contests, prize campaigns, promotional gifts or similar actions shall be governed by their legal terms or specific Particular Conditions, which must be available before participation and comply with the applicable regulations on consumers, advertising, data protection, electronic commerce and alcoholic beverages.

11. PURCHASE, BOOKING AND ELECTRONIC CONTRACTING PROCESS.

11.1. To purchase products or contract services through the online store, the Customer must follow the technical procedure enabled on the website.

11.2. In general, the process may include the following steps:

  • Selection of the product or service;

  • Selection of quantity, format, date, time, number of places, attendees or modality, where applicable;

  • Adding to the cart, initiation of the booking or access to the payment process;

  • Review of the order summary, selected product or service, price, taxes, costs and restrictions;

  • Entry of contact, billing, delivery, collection or attendance details;

  • Selection of the available shipping, collection or provision method;

  • Selection of the payment method and, where applicable, application of discount codes;

  • Confirmation of minimum age where the order includes alcoholic beverages or services involving the consumption, tasting or supply of alcohol;

  • Express acceptance of these Terms of Service and, where applicable, of the Legal Notice, as well as confirmation of having read the Privacy Policy and, where applicable, the provision of optional consent to receive commercial communications, news, invitations, promotions and DESTILO Club communications by electronic means;

  • Final confirmation of the order by means of the enabled contracting button or function.

11.3. Before finalising the order, the Customer may review the selected products or
services, their essential characteristics, total price, taxes, additional costs, delivery address, date and time of provision, payment method, applicable restrictions and other data entered, and may correct errors before confirming the purchase or booking.

11.4. The button or function by which the order is definitively confirmed must be identified by the wording "order with obligation to pay",
"Pay order", "Pay now" or another analogous, unequivocal and easily legible wording indicating that placing the order entails an obligation to pay.

11.5. Acceptance of these Terms of Service must be carried out by means of an affirmative action of the Customer before becoming contractually bound, without mere browsing of the website in itself implying acceptance of these conditions for a specific purchase or booking.

12. ORDER CONFIRMATION, CONCLUSION OF THE CONTRACT AND
FILING.

12.1. Once the order has been placed, DESTILO DRINKS shall confirm receipt of the acceptance by email or another equivalent electronic means, within a maximum period of twenty-four hours, or by means of a confirmation that can be immediately filed by the Customer once the contracting procedure has been completed.

12.2. Unless the confirmation communication expressly states that the
order is subject to review, the contract shall be deemed concluded when
DESTILO DRINKS confirms the order and receives sufficient confirmation of payment or authorisation of the transaction, without prejudice to the possibility of cancellation due to lack of availability, manifest error, legal impossibility, impossibility of delivery, impossibility of age verification or payment incident.

12.3. If DESTILO DRINKS is unable to accept or execute, in whole or in part, a confirmed order for legal, logistical, availability, payment or age verification reasons, it shall inform the Customer and refund the amounts corresponding to the part not executed, unless the Customer accepts an alternative, replacement or rescheduling.

12.4. DESTILO DRINKS may retain electronic evidence of the order, contractual acceptance, date and time of contracting, applicable version of the Terms of Service, confirmation communications, incidents, payments, deliveries and data necessary to evidence the contract, on the terms set out in the Privacy Policy.

12.5. The contract shall be formalised in Spanish, unless the online store allows valid contracting in another language. In the event of a discrepancy between versions, the Spanish version shall prevail, without prejudice to the Consumer's inalienable rights under the applicable mandatory regulations.

13. PAYMENT METHODS, SECURITY AND FRAUD PREVENTION.

13.1. The available payment methods shall be those indicated in the online store at any given time. Payment may be processed through external payment service providers, financial institutions, electronic commerce platforms or tools integrated into the payment process.

13.2. All payment transactions shall be subject to validation by the relevant payment provider, the issuing entity and, where applicable, strong authentication, fraud prevention, identity verification or risk control mechanisms.

13.3. DESTILO DRINKS shall not be responsible for rejections, blocks, delays or incidents attributable to the issuing entity, payment provider, payment gateway, lack of funds, incorrect data, anti-fraud controls, strong authentication, the Customer's connection or causes beyond its reasonable control.

13.4. The order shall not be deemed confirmed until DESTILO DRINKS has received sufficient confirmation of payment or authorisation of the transaction, unless another means of payment, billing or commercial credit has been agreed in writing.

13.5. DESTILO DRINKS may reject or cancel orders where there are reasonable indications of fraudulent use of means of payment, unauthorised transactions, identity theft, money laundering, abuse of promotions or unauthorised resale, without prejudice to reporting the incident to the competent authorities or entities where appropriate.

14. SALES TERRITORIES, DELIVERY AND COLLECTION METHODS.

14.1. DESTILO DRINKS shall only process orders within the territories enabled in the online store, on the product or service sheet, in the cart or during the payment process at any given time.

14.2. Before confirming the order, the Customer shall be informed of the applicable delivery restrictions, available shipping or collection methods, associated costs and accepted payment methods.

14.3. Territories initially envisaged: mainland Spain and the Balearic Islands.

14.4. Where collection is enabled at the store or at DESTILO DRINKS' physical studio, the Customer must select that option during the purchase process and collect the order within the schedules, timeframes and conditions indicated. For orders with alcoholic beverages, DESTILO DRINKS may request an official identity document before handing over the order.

14.5. DESTILO DRINKS may reject orders addressed to territories in which it cannot guarantee compliance with legal, regulatory, tax, logistical, age, storage or delivery restrictions.

15. SHIPPING, DELIVERY OF PRODUCTS AND TRANSFER OF RISK.

15.1. The shipping times, methods and costs shall be those indicated in the online store before the Customer becomes bound by the order. Indicative timeframe envisaged: 72 working hours in mainland Spain.

15.2. Unless a specific timeframe is expressly indicated, DESTILO DRINKS shall execute the order without undue delay and within the legally applicable timeframe. Timeframes may be affected by availability, preparation, weekends, public holidays, logistical incidents, time restrictions, storage conditions, age verification or force majeure.

15.3. The Customer must provide complete, truthful and up-to-date delivery details, including first name, surname, address, postal code, city, province, telephone where necessary and any reasonable delivery instruction. DESTILO DRINKS shall not be responsible for delays or impossibility of delivery arising from incorrect, incomplete or outdated data provided by the Customer.

15.4. Where the Customer acts as a consumer, the risk of loss of or damage to the Products shall pass when they or a third party indicated by them, other than the carrier, acquires material possession thereof, without prejudice to the legally applicable rules where the Customer commissions the transport to a carrier not offered by DESTILO DRINKS.

15.5. If the order arrives damaged, opened, tampered with, incomplete, broken, at an apparently inadequate temperature or with any visible incident, the Customer must notify DESTILO DRINKS without undue delay, providing, where reasonable, photographs, order number, packaging, transport label and a description of the incident.

15.6. For products requiring special storage conditions, refrigeration, protection from direct light, careful handling or consumption within a specific timeframe, the Customer must follow the instructions provided on the product sheet, label, packaging or documentation.

16. FAILED DELIVERY, AGE VERIFICATION AND TIME OR TERRITORIAL RESTRICTIONS.

16.1. If the order cannot be delivered due to the absence of the recipient, impossibility of access, incorrect data, refusal of receipt, lack of age verification, legal restriction, logistical restriction or cause attributable to the Customer, DESTILO DRINKS or the logistics operator may follow the retry, deposit, return, rescheduling or cancellation procedure indicated in the online store or communicated to the Customer.

16.2. Where the failed delivery is attributable to the Customer and the applicable costs have been previously notified, DESTILO DRINKS may pass on reasonable and evidenced costs of retry, return, storage, handling or re-delivery, without prejudice to the mandatory rights of the Consumer.

16.3. For orders that include alcoholic beverages, the recipient must prove the minimum legally required age when requested to do so. If that age cannot be verified, the Order shall not be delivered and DESTILO DRINKS may cancel the sale or arrange a new delivery to a recipient who meets the legal requirements, where possible.

16.4. The acceptance, preparation, supply, distribution, delivery or collection of orders with alcoholic beverages shall be subject to the age, territorial, time, administrative, tax and logistical restrictions applicable at the place of sale, dispatch, delivery, collection, supply or consumption.

16.5. Where a time or territorial restriction applies to alcoholic beverages, DESTILO DRINKS may prevent the completion of the order, suspend its acceptance, reschedule its preparation or delivery, limit collection, or cancel it with a refund of the corresponding amounts paid, without prejudice to the costs legally chargeable where the cause is attributable to the Customer.

17. TASTINGS, EXPERIENCES, WORKSHOPS, EVENTS AND ACTIVITIES AT THE STUDIO.

17.1. DESTILO DRINKS may offer tastings, experiences, workshops, events, tasting activities, training activities, activities at the physical studio, dinners, presentations, launches, clubs, private experiences or similar services.

17.2. The sheet or page of each service shall indicate, where applicable:

  • Name, description and essential content of the service;

  • Date, time, duration and place of the event;

  • Total price, taxes included, and additional costs if any;

  • Number of places available, minimum or maximum capacity and number of attendees included;

  • Minimum age and whether the Service includes alcoholic beverages, non-alcoholic beverages, food or materials;

  • Language of provision, access requirements, rules of conduct and punctuality recommendations;

  • Cancellation, modification, no-show, late arrival or attendee substitution policy;

  • Relevant information on allergens, intolerances, dietary restrictions, accessibility or special needs.

17.3. The Customer and attendees must present themselves at the indicated place, date and time. Late arrival may prevent full or partial participation in the service, especially where it affects the running of the activity, the other attendees, safety, capacity control or the contracted experience.

17.4. DESTILO DRINKS may deny participation or suspend the provision of the service to attendees who do not prove the required minimum age, show signs of intoxication, behave inappropriately, unsafely, violently, in a discriminatory, offensive manner or contrary to staff instructions, or who may endanger other attendees, staff, the premises or third parties.

17.5. The Customer must notify, with sufficient advance notice, any allergy, intolerance, dietary restriction, pregnancy, incompatible medication, accessibility need or circumstance relevant to the correct provision of the service. DESTILO DRINKS shall make reasonable efforts to meet such needs, but shall only be obliged to do so where it has expressly accepted them.

17.6. Unless expressly stated otherwise, experiences and activities involving alcohol tasting are aimed exclusively at persons of legal age. DESTILO DRINKS may offer non-alcoholic alternatives where these are provided for on the Service sheet or expressly accepted before contracting.

18. CANCELLATION, MODIFICATION, RESCHEDULING AND NO-SHOW IN SERVICES.

18.1. Bookings of services for a specific date or period shall be subject to the cancellation, modification or rescheduling policy indicated on the service sheet, during the payment process, in the confirmation communication or in the applicable Particular Conditions.

18.2. Unless otherwise indicated on the service sheet or in the Particular Conditions:

  • The Customer may request a date change up to 15 calendar days before the service, subject to availability;

  • Cancellations notified more than 15 calendar days in advance shall entitle the Customer, at their choice, to a date change or to the issuance of a credit for the amount paid for future purchases of products or experiences at DESTILO DRINKS, valid for 12 months from its issuance;

  • Cancellations notified less than 15 calendar days in advance may not entitle the Customer to the issuance of the credit or a date change, except for a legally justified cause;

  • The no-show of the Customer or attendee on the scheduled date and time may entail the loss of the amount paid, provided that this consequence has been notified before contracting and without prejudice to the mandatory rights of the Consumer;

  • The substitution of attendees may be accepted where the new attendee meets the age, access, health, safety and other applicable conditions, and it is communicated with sufficient advance notice.

18.3. DESTILO DRINKS may cancel or reschedule a service for organisational reasons, lack of minimum capacity, unavailability of the space, staff illness, unavailability of an essential product, administrative restrictions, safety risk, force majeure or any cause that prevents its correct provision.

18.4. In the event of a cancellation attributable to DESTILO DRINKS, the Customer may choose, subject to availability, between rescheduling the service, replacement with another equivalent service if they accept it, or a refund of the amounts paid for the cancelled service.

18.5. The impossibility of attending due to personal reasons of the Customer or attendee shall be governed by the cancellation policy applicable to the service, without prejudice to the possibility that DESTILO DRINKS may offer alternative commercial solutions where it deems appropriate.

19. RIGHT OF WITHDRAWAL FOR PRODUCTS.

19.1. Where the Customer has the status of consumer and purchases products at a distance, they may exercise the legal right of withdrawal within fourteen calendar days from receipt of the product, unless a legal exception applies.

19.2. To exercise the right of withdrawal, the Customer must communicate to
DESTILO DRINKS their decision by means of an unequivocal statement before the relevant period ends. They may use the model form included in Annex I, although its use is not mandatory.

19.3. The Customer must return the products without undue delay and, in any event, within a maximum period of fourteen calendar days from the date on which they communicate their decision to withdraw.

19.4. The products must be returned in adequate condition, without having been consumed, altered, deteriorated or handled beyond what is necessary to establish their nature, characteristics or functioning. Where the product has seals, labels, packaging or security elements, these must be preserved to the extent necessary to guarantee the hygiene, safety, traceability, storage and fitness of the product for its return, without prejudice to the mandatory rights of the Consumer.

19.5. The Customer shall be responsible for any diminished value of the products resulting from handling other than that necessary to establish their nature, characteristics or functioning.

19.6. Unless DESTILO DRINKS expressly states that it assumes the return costs or is legally obliged to assume them due to a lack of prior information or a more favourable commercial policy, the Customer shall bear the direct costs of return arising from the exercise of the right of withdrawal.

20. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL.

20.1. The right of withdrawal shall not apply where a legal exception exists and, in particular, where it applies in respect of:

  • Products made to the Customer's specifications or clearly personalised;

  • Products that may deteriorate or expire rapidly;

  • Sealed products that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery;

  • Products that, after delivery and having regard to their nature, have become inseparably mixed with other goods;

  • Alcoholic beverages whose price was agreed at the time of concluding the sales contract and that cannot be delivered within thirty days, where their actual value depends on market fluctuations that
    DESTILO DRINKS cannot control;

  • Services related to leisure activities, food, tastings, workshops, experiences, visits, tasting activities or events, where the contract provides for a specific date or period of performance;

  • Services fully performed, where the Customer has expressly requested the start of the provision during the withdrawal period and has been informed that, once the service has been fully performed, they will lose their right of withdrawal.

20.2. The exclusion of the right of withdrawal is without prejudice to the rights to which the Customer may be entitled for lack of conformity, breach of contract, cancellation attributable to DESTILO DRINKS, error in the product delivered, food safety, defective product or any other right recognised by mandatory law.

21. REFUNDS FOR WITHDRAWAL, CANCELLATION OR
RETURN.

21.1. Where the Customer validly exercises the right of withdrawal, DESTILO DRINKS shall refund all payments received, including, where applicable, the ordinary delivery costs, without undue delay and, in any event, within a maximum period of fourteen calendar days from the date on which it was informed of the decision to withdraw.

21.2. DESTILO DRINKS may withhold the refund until it has received the
returned products or until the Customer has provided proof of return, whichever condition is met first.

21.3. The refund shall be made using the same means of payment used by the Customer in the initial transaction, unless the Customer has expressly provided otherwise and provided that they do not incur any cost as a result of the refund.

21.4. In the event that the Customer has expressly selected a delivery method more costly than the ordinary method offered by
DESTILO DRINKS, DESTILO DRINKS shall not be obliged to refund the additional costs arising from that method.

21.5. Refunds for cancellation of services, lack of availability, failed delivery, error, defect, lack of conformity or logistical incident shall be governed by these Terms of Service, by the accepted Particular Conditions and by the applicable mandatory regulations.

22. INCORRECT, DAMAGED, DEFECTIVE OR NON-CONFORMING PRODUCTS.

22.1. If the Customer receives an incorrect, damaged, defective, incomplete or non-conforming product, they must notify DESTILO DRINKS through the service channels indicated in these Terms of Service, providing a description of the incident and, where reasonable, photographs, order number, proof of purchase, packaging, transport label or other relevant documentation.

22.2. In the event of a lack of conformity, the Customer shall be entitled to the remedies provided for by law, including, where applicable, repair, replacement, price reduction or termination of the contract, free of charge for the consumer on the terms provided for by law.

22.3. Where the incident is attributable to DESTILO DRINKS or to the transport contracted by DESTILO DRINKS, DESTILO DRINKS shall bear the reasonable costs of return, replacement, re-shipment or refund as applicable.

22.4. For food products, beverages or other perishable, refrigerated, live goods or goods subject to special storage conditions, the lack of conformity must be assessed having regard to the nature of the product, its minimum durability or use-by date, storage conditions, transport, instructions provided, the Customer's handling and appropriate use of the product.

22.5. The foregoing rights shall not affect any additional commercial guarantee that may, where applicable, be expressly offered, nor the rights arising from food safety or product liability.

23. LEGAL GUARANTEE OF CONFORMITY.

23.1. Products sold to consumers are subject to the legal conformity regime provided for in the consumer and user regulations.

23.2. DESTILO DRINKS shall be liable to the consumer for any lack of conformity existing at the time of delivery and becoming apparent within the legally provided periods, unless an exception applies due to the nature of the product or the contract.

23.3. The legal guarantee does not cover damage, loss of quality or deterioration arising from improper handling, incorrect storage, exposure to inadequate temperatures, opening, partial consumption, use contrary to instructions, negligence of the Customer or circumstances after delivery not attributable to DESTILO DRINKS.

23.4. Where the product has a commercial guarantee from the manufacturer, producer or third party, that guarantee shall apply in accordance with its own terms, without limiting the legal guarantee to which the consumer is entitled vis-à-vis DESTILO DRINKS.

24. GIFT VOUCHERS, CARDS, INVITATIONS AND PROMOTIONAL CREDITS.

24.1. DESTILO DRINKS may offer gift vouchers, gift cards, invitations, promotional credits, redeemable codes or commercial advantages to purchase products or services.

24.2. Unless otherwise indicated in their Particular Conditions:

  • They shall have the validity indicated at the time of purchase or issuance;

  • They shall not be redeemable for cash;

  • They may be subject to the availability of products, places, dates, schedules, territories or minimum age;

  • They may not be used to purchase, book or supply alcoholic beverages to minors;

  • The loss, misuse, copying or unauthorised communication of the code shall be the Customer's responsibility, except for a cause attributable to DESTILO DRINKS.

24.3. Where a gift voucher or promotional credit has no specific execution date, the regime of withdrawal, use, expiry, cancellation and return must be analysed in accordance with the applicable regulations and their Particular Conditions.

25. BILLING.

25.1. The Customer may request an invoice in accordance with the applicable regulations by providing the data necessary for its issuance.

25.2. The Customer shall be responsible for ensuring that the billing data provided is complete, accurate and up-to-date. DESTILO DRINKS shall not be responsible for errors arising from incorrect or incomplete data provided by the Customer.

25.3. Invoices may be issued in electronic format where applicable and in accordance with the applicable regulations.

25.4. B2B, wholesale, hospitality, distribution, private event or collaboration sales may be subject to specific billing, payment, credit, tax, delivery or return conditions.

26.3. Where a claim submitted by a Consumer is not resolved satisfactorily, DESTILO DRINKS shall provide them, on a durable medium, with information on the competent alternative dispute resolution entity and on whether it is obliged or agrees to participate in the corresponding procedure.

26.4. DESTILO DRINKS is not adhered to the Consumer Arbitration System, without prejudice to the possibility that it may accept its intervention for a specific dispute.

26.5. The foregoing information is without prejudice to the right of the
consumer to turn to the competent consumer authorities, courts and tribunals, or applicable alternative dispute resolution entities.

27. PERSONAL DATA PROTECTION.

27.1. The processing of the personal data of users, customers, recipients, attendees and contact persons is governed by the Privacy Policy available on the website.

27.2. DESTILO DRINKS may process the data necessary to manage orders, payments, billing, shipments, collections, returns, refunds, claims, communications, age verification, bookings, event attendance, enrolment in or participation in DESTILO Club, invitations, preferences communicated by the Customer, commercial communications where applicable, dietary or accessibility needs communicated by the Customer and compliance with legal obligations.

27.3. Where the Customer provides personal data of third parties, including recipients, attendees or persons authorised to collect an order, they declare that they have a sufficient legitimate basis to communicate them and undertake to inform them of the Privacy Policy where applicable.

28. INTELLECTUAL PROPERTY, PRODUCT CONTENT AND USE OF MATERIALS.

28.1. The trademarks, trade names, logos, photographs, texts, designs, product sheets, tasting notes, content, images, packaging, website structure and other elements incorporated into the online store are owned by DESTILO DRINKS or by the corresponding third-party licensors, suppliers or owners.

28.2. The purchase of products or contracting of services does not confer on the Customer any licence, assignment or authorisation over the intellectual or industrial property rights of DESTILO DRINKS or of third parties, except for the strictly private and ordinary use of the products or materials purchased.

28.3. The reproduction, distribution, public communication, transformation, extraction, scraping, commercial exploitation or unauthorised use of content, product sheets, photographs, trademarks, designs, tasting notes or website materials is prohibited, except with prior written authorisation or in legally permitted cases.

29. LIABILITY, FORCE MAJEURE AND CONTRACTUAL LIMITS.

29.1. DESTILO DRINKS shall be liable for the fulfilment of its contractual obligations on the terms provided for in these Terms of Service, in the applicable Particular Conditions and in the corresponding mandatory regulations.

29.2. DESTILO DRINKS shall not be liable for breaches, delays, impossibilities of delivery or incidents arising from causes beyond its reasonable control, including supervening unavailability of suppliers, non-attributable logistical incidents, administrative restrictions, force majeure, strikes, telecommunications failures, errors in data provided by the Customer, refusal of receipt, impossibility of verifying age, misuse of the website or the Customer's failure to comply with storage instructions.

29.3. The foregoing is without prejudice to the liability that legally corresponds to DESTILO DRINKS for breach of contract, wilful misconduct, gross negligence, lack of conformity, product safety, pre-contractual information, consumer rights, data protection, liability for defective products or other mandatory obligations that cannot be legally excluded.

29.4. The Customer shall be liable, to the extent legally applicable, for the damages, costs or liabilities arising from false data, fraudulent use of means of payment, purchase for minors, unauthorised resale, misuse of promotional codes, incorrect handling of products, failure to comply with instructions or conduct contrary to the law, the Legal Notice or these Terms of Service.

30. MODIFICATION OF THESE TERMS.

30.1. DESTILO DRINKS may modify these Terms of Service where necessary due to regulatory, technical, commercial, organisational, logistical, service, supplier, payment method, delivery territory, offered product or commercial policy changes.

30.2. The modifications shall apply from their publication on the website and shall not affect orders already confirmed, unless they are required by mandatory law or are more favourable for the Customer.

30.3. The version applicable to each order shall be the one accepted by the Customer at the time of contracting, without prejudice to the accepted Particular Conditions and the corresponding mandatory rights.

31. LANGUAGE, INTERPRETATION AND PARTIAL NULLITY.

31.1. These Terms of Service may be available in several languages. In the event of a discrepancy between versions, the Spanish version shall prevail, without prejudice to the inalienable rights to which consumers and users may be entitled under the mandatory regulations applicable in their place of habitual residence.

31.2. The headings of the clauses are for guidance purposes only and shall not affect the interpretation of the content of the Terms of Service.

31.3. If any clause of these Terms of Service is declared null, invalid, unfair, illegal or unenforceable, in whole or in part, that declaration shall not affect the validity of the remaining clauses, which shall retain their full effect to the extent legally permitted.

31.4. The affected clause shall be deemed not to have been included to the extent legally applicable, without prejudice to the effects that the applicable regulations attribute to its nullity and without it being able to be integrated or reinterpreted to the detriment of the
consumer.
